Website: https://www.goncalo-fernandes.com

Services may include:

  • Live musical performances

  • Weddings and private events

  • Corporate events and receptions

  • Concerts and artistic productions

  • Music lessons and workshops

  • Music arrangements and artistic collaborations

  • Audiovisual and interdisciplinary projects

  • Combined music and audiovisual service packages

The scope and conditions of each service will be specified in the individual quotation, agreement, or booking confirmation.

These Terms & Conditions apply where they have been validly incorporated into the relevant contract.

Mandatory statutory consumer rights remain unaffected.

2. Enquiries and Booking Confirmation

Submitting an enquiry through the website, by email, or through another communication channel does not automatically create a binding booking.

Following an enquiry, a quotation may be provided outlining the proposed services, fees, availability, and relevant conditions.

A booking becomes binding when the parties reach an agreement on the essential contractual terms and confirm their intention to enter into a contract.

Where a written quotation specifies a deposit or other booking requirement, the applicable conditions will be stated before the booking is finalised.

3. Services and Performance Scope

The precise services provided will be determined by the agreed quotation or contract.

For musical performances, this may include:

  • Performance date and location

  • Agreed performance duration

  • Musical programme or repertoire

  • Number of musicians

  • Equipment requirements

  • Rehearsal arrangements

  • Travel and accommodation requirements

Additional services not included in the original agreement may require a separate quotation.

4. Fees and Payment

All fees will be communicated before the booking is confirmed.

Prices quoted to consumers will identify the applicable total price, including taxes where required.

Any additional costs, such as travel, accommodation, equipment rental, or special arrangements, will be clearly identified before the contract is concluded.

A booking deposit may be requested where agreed in advance.

The amount of any deposit, payment schedule, and final payment deadline will be specified in the individual agreement or invoice.

Payments must be made using an agreed payment method.

Late-payment consequences are governed by applicable German law.

5. Client Responsibilities

The client is responsible for providing accurate information relevant to the agreed service.

For performances and events, this may include:

  • Correct event date, time, and location

  • Suitable performance space

  • Safe access to the venue

  • Appropriate environmental and technical conditions

  • Necessary permissions and access arrangements

  • A point of contact for event coordination

Where technical equipment is required, responsibilities for supplying and operating that equipment will be agreed in advance.

Changes affecting the performance or service should be communicated as early as possible.

6. Musical Repertoire and Artistic Preparation

Musical programmes and repertoire may be discussed and agreed before the event.

Requests for specific pieces, arrangements, or additional repertoire are subject to feasibility, preparation time, and any relevant licensing requirements.

Special arrangements, transcriptions, or additional rehearsals may involve additional fees, which will be agreed before the work is undertaken.

Reasonable artistic adjustments may be necessary during a live performance, provided the essential agreed service is maintained.

7. Travel, Accommodation and Additional Expenses

Travel and accommodation expenses are included only where expressly stated in the quotation or contract.

Where additional expenses are necessary, they will be agreed before the booking is finalised.

Any significant changes to the event location or schedule may require adjustments to the agreed arrangements.

8. Changes to Bookings

Requests to change a confirmed booking should be submitted as soon as possible.

Changes to the date, duration, location, personnel, or scope of services are subject to mutual agreement and availability.

Additional services or materially different arrangements may involve revised fees.

Neither party is obliged to accept material contractual changes without agreement.

9. Cancellation and Rescheduling

Cancellations and rescheduling requests are governed by the separate Booking & Cancellation Policy, where that policy has been validly incorporated into the contract.

Mandatory statutory cancellation, withdrawal, termination, and other consumer rights remain unaffected.

Any cancellation charges must comply with applicable law and the relevant contractual agreement.

10. Illness and Unforeseen Circumstances

If illness, accident, or circumstances beyond reasonable control prevent an agreed performance, I will notify the client as soon as reasonably possible.

Where suitable and agreed by the client, an alternative qualified performer or an alternative date may be proposed.

Any replacement or rescheduling arrangement requires the parties' agreement where it materially changes the contracted service.

If the agreed service cannot be provided, payment and refund obligations will be determined by applicable law and the individual contract.

11. Audiovisual Services

Where audiovisual services are included, the quotation or contract will define:

  • Filming and recording requirements

  • Agreed deliverables

  • Editing and post-production services

  • Delivery arrangements

  • Usage rights

  • Applicable delivery deadlines

  • Any agreed revision process

Unless otherwise agreed, delivery of audiovisual material does not automatically transfer all copyright or exploitation rights.

Any rights granted to the client will be defined in the relevant agreement.

12. Photography, Audio and Video Recording

The recording, broadcasting, or commercial distribution of live performances may involve copyright, performers' rights, privacy rights, and other legal obligations.

Commercial recording or exploitation rights are not automatically granted through the purchase of a live performance service.

Any required rights and permissions must be agreed separately.

Responsibility for obtaining necessary third-party permissions, including venue or audience permissions, will be determined by the circumstances and the individual agreement.

13. Intellectual Property

Original arrangements, compositions, artistic concepts, recordings, and other protected creative works remain the intellectual property of their respective rights holders.

No copyright transfer is implied unless expressly agreed.

Any agreed licence is limited to the purpose and scope specified in the relevant contract.

14. Liability

Liability is governed by applicable German law.

Nothing in these Terms & Conditions excludes or limits liability for intent, gross negligence, injury to life, body or health, or any other liability that cannot lawfully be excluded or restricted.

Any further limitation of liability applies only to the extent permitted by applicable law.

15. Consumer Rights and Right of Withdrawal

Consumers may have statutory withdrawal rights when entering into distance or off-premises contracts.

An exception may apply to certain services connected with leisure activities scheduled for a specific date or period, pursuant to § 312g(2) No. 9 BGB.

The applicability of an exemption depends on the nature of the individual contract.

Any statutory withdrawal right or applicable exemption will be explained to the consumer before the contract is concluded.

These Terms & Conditions do not replace legally required withdrawal information.

16. Applicable Law

The contractual relationship is governed by German law, subject to applicable mandatory consumer-protection provisions.

For consumers habitually resident in another country, the choice of German law does not deprive them of mandatory protections applicable under relevant law.

The competent courts are determined by applicable statutory jurisdiction rules.

17. Severability

If any provision of these Terms & Conditions is invalid or unenforceable, the remaining provisions remain effective to the extent legally permitted.

Applicable statutory rules govern matters affected by invalid provisions.
